The past few years have been marked by significant developments in case law regarding disputes arising from property insurance contracts. The legal positions formulated by the courts have already had, and will continue to have, a significant impact on the Russian insurance market (and not only with regard to property insurance), both in terms of insurers’ approaches to assessing the risks they underwrite and directly in terms of insurance terms and conditions (the wording of insurance rules/contracts) and the scope of insurance coverage provided. Courts are taking an increasingly comprehensive approach to analyzing insurance legal relationships when resolving disputes arising from them, going far beyond a literal interpretation of the terms of the insurance contract.
In particular, 2025 was marked by several decisions of the Supreme Court of the Russian Federation, in which a number of legal positions were formulated, some of which can be described as “revolutionary” for the Russian insurance market, including on the issue of distinguishing between exclusions from insurance coverage and grounds for exempting the insurer from paying insurance compensation. These positions of the Supreme Court of the Russian Federation have already been reflected and have led to unexpected developments in the decisions of lower courts.
The KKMP team invites anyone interested in the topic to participate in the seminar “Property Insurance: Key Points of Judicial Practice,” during which we will discuss the most interesting and significant decisions of Russian courts that may influence both insurance terms (the wording of insurance rules/contracts) and the scope of insurance coverage, as well as the further development of legal practice regarding property insurance contracts and, possibly, other types of insurance.
